Terms and Conditions

These terms and conditions (“Agreement”) govern the relationship between Jenna Abadi, an independent travel advisor (“Travel Advisor” or “we”), and you, the purchaser of travel services or lead traveler (“Client” or “you”).

1. Use of Travel Advisor’s Services

You represent and warrant that:
a. You are at least 18 years of age and are authorized to enter into this Agreement and make travel bookings with Travel Advisor;
b. The information you provide (whether for you or on behalf of others) is true and accurate, and you will update it throughout your engagement with Travel Advisor; and
c. You will abide by the terms and conditions of this Agreement and any applicable terms of our travel suppliers or partners.

2. Independent Travel Advisor

a. Travel Advisor is an independent travel advisor of Fora Travel and operates its own separate travel business. Client understands and agrees that:
i. Travel Advisor is not an agent, representative, or employee of Fora;
ii. Fora is a technology provider and host agency, not a travel service provider;
iii. Client will have no claim against Fora for losses or damages arising from Travel Advisor’s services; and
iv. Fora is not a party to this Agreement. Client waives any claims against Fora related to travel arrangements, cancellations, or disputes.

3. Services; Planning Fees

a. Travel Advisor provides travel planning services, including researching and booking accommodations, transportation, activities, and tours based on Client preferences and budget.
b. Travel Advisor may charge a planning fee, agreed in writing. Planning fees are non-refundable and due before work begins.

4. Suppliers; Client Responsibility

a. Travel Advisor acts as a liaison between Client and travel suppliers. Suppliers are independently responsible for providing the booked services.
b. Client consents to the use of disclosed suppliers and is responsible for evaluating their services. Travel Advisor is not responsible if Client is dissatisfied with final choices.
c. Travel Advisor does not guarantee supplier rates, services, or special requests. Travel Advisor is not liable for changes, delays, cancellations, or force majeure events.

5. Travel Bookings

a. Rates: All prices are in CAD unless stated. Prices may change due to demand, availability, or currency fluctuations.
b. Confirmed Bookings: Subject to supplier confirmation.
c. Personal Information: Client authorizes Travel Advisor to use personal info for bookings, tickets, tours, and other services.
d. Payment: Client will pay suppliers directly or via Fora as directed.
e. Credit Card Authorization; Disputes: You may keep a credit card on file for authorized charges. You agree not to dispute charges with your bank unless services were not provided or were grossly misrepresented.
f. Independent Bookings: Travel Advisor is not responsible for independently arranged travel.
g. Nonrefundable Bookings; Modifications: Client is subject to suppliers’ cancellation, deposit, and modification policies. Travel Advisor requires 48 hours notice for changes; associated costs may be passed to Client.
h. Travel Insurance: Highly recommended. Client is responsible for costs due to cancellations, interruptions, or supplier penalties if uninsured.

6. Government Identification and Travel Advisories

a. Denial of Entry: Client is responsible for proper travel documents. Denied entry may result in total financial loss; no refund is owed.
b. Passports & Visas: International travel requires valid passports (usually 6 months beyond travel) and visas as applicable.
c. Traveling with Minors: Minors may require consent letters or documentation. Client is responsible for compliance with Canadian and destination requirements.
d. Travel Advisories: Client is responsible for reviewing travel advisories issued by the Government of Canada and the destination countries. Participation implies acceptance of risk.

7. Liability; Damages; Force Majeure

a. Travel Advisor acts solely as an authorized seller for disclosed suppliers. Not liable for injury, property damage, errors, omissions, cancellations, or operational failures of suppliers.
b. Client agrees that any recovery from Travel Advisor is limited to commission and fees actually received.
c. Travel Advisor is not liable for delays or failures due to events beyond control (natural disasters, civil unrest, pandemics, government action, etc.).

8. General

a. Modifications: Travel Advisor may amend this Agreement at any time; updates are effective immediately.
b. Governing Law: This Agreement is governed by the laws of Canada. Any disputes arising out of or relating to travel bookings shall be resolved under Canadian law in the appropriate Canadian courts.
c. Third-Party Beneficiaries: Only Client and Travel Advisor are intended beneficiaries.
d. Timeliness; Claims: Claims must be brought within 12 months of trip completion. No punitive or class-action claims.
e. Severability: Invalid provisions do not affect the remainder of this Agreement.
f. Entire Agreement: This constitutes the full agreement.
g. Acceptance: By booking, Client consents to these terms.
